Music Page faces a new process due to ‘Dazed and Confused’

Composer Jake Holmes, who has already sued Led Zeppelin, says he was not credited with the initial versions of Yardbird music

The singer and songwriter Jake Holmes resumed an old dispute with Jimmy Pagefrom LED ZEPPELINabout the composition credits of “Dazed and Confused”.

The new Holmes process for copyright violations claims that he did not receive the appropriate credits or royalties for early versions of music made by Yardbirdsincluding a recording presented in the recent documentary Becoming Led Zeppelin. According to Holmes, he sent extrajudicial notifications to Page and other defendants last month, but got no response, which led him to file the lawsuit.

Holmes composed and recorded “Dazed and Confused” In 1967, and Page would have heard the track in August of that year, after the singer opened a show for the Yardbirds in Greenwich Village (the song also appears on the 1967 Holmes album The Above Ground Sound of Jake Holmes). Shortly thereafter, the Yardbirds created their own version of the song and played live – although they never recorded a studio version, several live recordings date from 1967 and 1968.

The song, however, marked Page, who reworked her with Led Zeppelin. Although it has written a new letter, the main instrumental melody – especially the famous descendant riff – remained quite similar to the original Holmes.

For years, Holmes avoided commenting on the version of Zeppelin, having even said once: “I thought, ‘Ah, let go, let him stay with it'”. But in 2010, he filed a lawsuit for copyright violations against Page, which was eventually resolved outside the courts.

As part of the agreement, the credits of the Led Zeppelin version of “Dazed and Confused” started to say that she was “Inspired by Jake Holmes”. Holmes kept copyright about its original composition, but it is unclear whether the agreement has defined how yardbird recordings should be credited.

As the new Holmes process points out, in the last three years, several Yardbird file releases have included live recordings of “Dazed and Confused”. Holmes claims that these versions were incorrectly credited to Jimmy Page, so he did not receive any royalty.

In addition, Holmes argues that in the documentary Becoming Led Zeppelinthe version of Led Zeppelin of “Dazed and Confused” appears correctly credited as “Written by Jimmy Page, inspired by Jake Holmes”but the Yardbird version is credited only as “Written by Jimmy Page”.

The process states:

“The performance of the Yardbirds of ‘DAZED AND CONFUSED’ In the movie is a performance of Holmes composition. The defendants committed multiple acts of intentional infraction by continuing to use Holmes composition without permission, even aware of the rights of the plaintiff and after the extrajudicial notification sent by the author. ”

A Jimmy Page lawyer did not immediately respond to the request for comment Rolling Stone.
