The Supreme Court ruled Thursday that the Biden administration correctly completed a Trump-era policy that forced some American asylum seekers to wait in Mexico.
Judges 5-4 came to the government in the “Stay in Mexico” case during President Donald Trump’s presidency. Chief Justice John Roberts drafted the verdict and was joined by fellow Conservative Brett Cavanaugh, as well as the court’s three liberal justices: Stephen Breyer, Sonia Sotomayor and Elena Kagan.
President Joe Biden suspended the program in January 2021, the first day of his term. But lower courts ordered his reinstatement in response to a lawsuit filed by Republicans in Texas and Missouri. The current administration has sent far fewer people to Mexico than the Trump administration.
The basis of the legal battle was whether immigration authorities, who had far fewer opportunities for detention than necessary, would have to send people to Mexico, if they had the discretion of federal law, to release asylum seekers in the United States. be heard.
Some 70,000 people have signed up for the program, officially known as the Migrant Protection Protocols, since President Donald Trump launched it in 2019 and made it the center of efforts to detain asylum seekers.
After Biden suspended the program, Homeland Security Secretary Alejandro Mallorca completed it in June 2021. In October, the department presented additional justifications for the policy’s collapse, but to no avail.
The program resumed in December, but about 3,000 migrants had registered by the end of March, at a time when authorities had detained migrants about 700,000 times at the US-Mexico border.
On the administration side were democracies and progressive groups. States led by Republicans and conservative groups sided with Texas and Missouri.
