The actress Regina Duarte was convictedby the Special Civil Court of Lagoa, in Rio de Janeiro, pay R$30 thousand in compensation in a lawsuit brought by the director and screenwriter Janaina Diniz Guerra.

The director, that is daughter of actress Leila Dinizaccused her of inappropriate use of the mother’s image. In December 2022, Regina published a video reproducing a speech by former president Jair Bolsonaro in defense of the military dictatorship.

At the moment in which Bolsonaro states that “1964 was a request from society” and that “the women in the streets were asking for the re-establishment of order”, the image that appears is the photograph of the actresses Eva Todor, Tônia Carrero, Eva Wilma, Leila Diniz, Odete Lara and Norma Bengell, protesting against censorship during the dictatorship.

In the sentence, Regina was ordered to remove the publication from her social networks within 48 hours under penalty of a daily fine of R$ 1,000. She will also have to portray herself on all her social videos and explain that Leila Diniz has never supported the military dictatorship and that the photo used was taken in a context of opposition to the regime and censorship.

“The life path of the actress Leila Diniz has always been marked by the defense of freedom, against censorship, against the military dictatorship and its conservative moralism. Linking the actress’s image to such an explicit defense of the military dictatorship is absurd and deserves all the revulsion and punishment. This is an improper and serious use of the actress’s image, in defense of the military coup, which occurred on a date very close to the January 8 attacks”, stated the lawyer Maria Isabel Tancredo, who represents Janaina Diniz in the trial, according to the columnist Ancelmo Gois, from The globe.

Janaina also stated that the trial was motivated by the defense of Leila Diniz’s path and legacy. “The defamatory use of my mother’s image is unacceptable and leaves me deeply indignant. People must learn to have respect for the memory of others, for the image built over a lifetime,” she said.

A supporter of former president Jair Bolsonaro, Regina was head of the Culture Department between March and May 2020. The performance displeased both the artistic class and the far-right wing of the government.
