The character was arrested for falsely supposing the murder of his sister, Odete Roitman
Summary
The character Celina, from “Vale Tudo”, could be arrested for perjury by lying to the police, but her recantation before sentencing would extinguish the penalty provided by law, an expert highlights.
The character of Celina Junqueira (Malu Galli), from the remake of Everything is fine (Globo), lied when he said he killed Odete Roitman (Debora Bloch) to protect his niece, Helena Roitman (Paolla Oliveira). But in real life, could a person be arrested for doing something similar?

According to lawyer Antilia Reis, a specialist in the defense of people in vulnerable situations, Celina’s conduct theoretically falls within the crime of perjury, which consists of making false statements, denying or concealing the truth. The expected punishment is imprisonment from two to four years.
“In the case under analysis, he lied by falsely declaring that he had killed Odete Roitman, which characterizes a notoriously false statement, potentially capable of misleading the police authorities and the courts, configuring the criminal typology I mentioned”, explained Antilia, in an interview with Earth.

The expert adds that, if the false confession hinders the investigation, leads to the arrest of innocent people or diverts the course of the investigation, the person may also be liable to defamatory charges – a more serious crime, the penalty for which is increased by one sixth to one third if committed with corruption or with the aim of obtaining a procedural advantage.
In Celina’s case, false testimony in favor of Heleninha could in fact increase the sentence. However, the character recognized her mistake before anyone was hurt, which freed her from prison.
“Celina retracted before the sentence, during the confrontation with Heleninha, when she confessed the falsity of her statements. In this case, the law provides that the fact will no longer be punished, as long as the officer retracts or tells the truth before the sentence. Therefore, although Celina’s conduct satisfies the typical elements of the crime of perjury, the timely retraction prevents punishment and extinguishes the punishability of the crime of perjury testimony. done.”
Despite the fictional context of Everything is fine (Globo), the lawyer warns that, in life, people should not behave in the same way, since “this can lead to flagrant or preventive arrest, depending on the case”.
