Kroy "KJ" Biermann Jr., the 15-year-old son of Real Housewives of Atlanta star Kim Zolciak and former NFL player Kroy Biermann, was indicted on seven charges on Sept. 3, according to court documents obtained by E! News. The indictment follows his Aug. 17 arrest in Alpharetta, Georgia.
A Fulton County grand jury validated the charges, which include aggravated child molestation, aggravated sexual battery, aggravated sodomy, sexual battery against a child under 16 and false imprisonment, among other counts related to sexual assault. The indictment alleges KJ "did unlawfully commit an immoral and indecent act" with a "child under the age of 16 years" on April 23.
What the Charges Allege
The false imprisonment charge accuses KJ of "unlawfully" detaining the victim "without legal authority and violation of the personal liberty" of the minor. According to a criminal warrant obtained by E! News, the alleged incident took place in a changing room at a Lifetime Fitness gym.
KJ was 14 years old at the time of the alleged events and was 15 when he was arrested, according to his attorney.
Attorney Speaks Out for KJ
After the indictment, KJ's attorney, Jason Sheffield, issued a statement maintaining his client's innocence. "I respect the difficult responsibilities carried by prosecutors and victim advocates," Sheffield wrote in the statement to E! News. "Cases involving children require patience, care, and a commitment from all of us to understanding the full picture as the process continues."
"There are two children at the center of this case. KJ was 14 years old when these events allegedly occurred. He was arrested at 15 and, less than three weeks later, indicted on charges carrying extraordinary consequences," Sheffield continued. "But adult consequences do not transform a child into an adult. The choices and conduct of children should not suddenly be viewed through an adult lens simply because the consequences are severe."
Sheffield argued that an arrest and indictment "cannot tell us the whole truth of a case" because the magistrate judge and the grand jury "have heard only one side," noting that the accused "has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding. That is not a criticism of the process; it is simply where we are."
The attorney said he believes the evidence he has gathered will clear KJ. "Without DNA evidence, the case remains one of 'she said, he said' and the credibility of the accuser. The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations," he said. "God willing, that place will be juvenile court, where the lives of these young people can be respected and honored."
Sheffield closed his statement by asking the public to be respectful online. "Until then, these are children whose lives should not become something for adults to 'thumbs up' or 'heart' on social media," he said. "We should not cheer against children."
Kim Zolciak's Defense of Her Son
After KJ was taken into custody on Aug. 17, Zolciak spoke out in his defense, saying he had passed a voluntary polygraph test and that no DNA evidence was found during an investigation into the alleged incident.
"The allegations being made against my son are nothing short of reckless and deeply troubling," Zolciak told E! News in an Aug. 21 statement. "He categorically denies ever being involved with this woman or engaging in the conduct she has alleged."

Zolciak rose to fame on The Real Housewives of Atlanta before starring in her own Bravo spinoff, Don't Be Tardy, alongside Biermann, a former linebacker who spent his NFL career with the Atlanta Falcons. The couple filed for divorce in February 2025.
