The next morning he found it completely frozen around a spoon in a glass. This fortuitous innovation marked the birth of the world’s first popsicle.
After this discovery, Epperson began making popsicles every day and, 18 years later, patented his “epsicle,” which his children affectionately called the “popsicle.” In 1923 he began marketing the lui popsicle in Neptune Beach, Florida, gaining local popularity and attracting the attention of the Joe Lowe Company of New York, which purchased the lui patent in 1929.
However, the sale of the patent did not bring prosperity to Epperson, marking the end of his profitable path and the beginning of legal disputes. The most notable rivalry occurred between Good Humor (Kibon in Brazil) and Popsicle.

Good Humor claimed that Popsicle had infringed its patent for a chocolate-covered ice cream bar on a stick, sparking legal battles in US federal courts that were only resolved in 1989, when Unilever, Kibon’s owner, acquired Popsicle.
The legal dispute was a saga that reflected the complexity of the ice cream and popsicle industry in the absence of standardized definitions. The final resolution stated that Kibon would retain the rights to milk-based ice cream and sweet sticks, while Popsicle would have supremacy over water- and fruit-based popsicles.
