Andreani has announced the suspension of services; Foundation denies unexpected interruption and impact on the production of vaccines
Andreani Logística announced on Tuesday 29, the suspension of the services provided to the Foundation Buttanincluding the storage of inputs used in the production of vaccines. The Research Center, in turn, states that the contract with the company has been terminated within the expected deadline and denies any unexpected interruption.
Andreani’s version, however, is different. According to the company, the original contract was in force since April 2023 in April 2024, with a request from the Foundation for the operation to be maintained for another six months, while a new offer has been developed. The extension was expected to end on September 30th. In August, however, Butan had already selected the Sima Logística company as the winner of the competition.
On September 30, the Foundation would have sent to Andreani a unilateral extension of the contract until April 2025 – a decision that the company claims to have not accepted or signed. “We are providing a service without a contract. There is no unilateral business and Butantan has acted arbitrary. This is discussed in court,” says Andreani.
The dispute for the management of logistics, storage and distribution of vaccines has already been taken Court of Justice of San Paolo (TJSP) e State Court of Auditors (TCE-SP), after Andreani, second in the event, disputes the legality of Simas’ assumption. One of the main questioning points is the transparency of the process. According to Andreani, the announcement requested the presentation of a license that demonstrated the performance of the company in San Paolo – which would facilitate logistics – but the SIMA document was not made available even after the formal request.
Another point of criticism of Andreani is what he considers “the lack of preparation of the new carrier”. According to the company, in the last 48 hours, the Butandan equipment under his guard have been transferred to a foundation farm and not in Sima structures, in a movement that would have demonstrated the absence of an adequate structure.
Andreani says that the only movement requested so far was this. The complaint was brought to the prosecutor.
Although the official start of Sima’s activities were scheduled for April 17, Andreani claims to have continued to receive goods. “From 1 to 28 April we received 340 input pallets, 40 only Monday 28,” he says. The company also states that none of these materials has been taken so far: a version contested by Butantan, who reports that he has transferred 900 pallets to the new carrier.
According to Andreani, the services were maintained without contract and with unilateral values determined by Butantan. The company states that, from Wednesday 30 years, it will no longer receive new inputs and transport loads already stored by the function to which it is also under its responsibility: if a detailed transfer program is not presented legally supported, as regards the previously agreed commercial values and complete access to the documentation of the offer process.
The company also states that Imbroglio puts the integrity of the inputs at risk. It guarantees that the loads under your care will continue stored and chilled, but refuses to receive new storage inputs or to transport those that are already preserved.
What does Butandan say?
Butann Foundation says that Simas Logística, the offer winner, has a qualified shed and has started to receive inputs from April 3 – information, which, ensuring, were previously communicated to Andreani.
Initially, the Foundation states that the discovered materials have been sent and, from April 30, the new operator will also receive refrigerated inputs. “More than 900 pallets have already been transferred to the SIMA structures and it is expected that all migration will be completed by the end of May,” says Butantan.
The Research Center also underlines that the contract with Andreani was signed for the inapplicability of the offer – a different method of emergency assumption – and has been unilaterally extended on the basis of law 14.133/2021. “The company continues to provide services until the end of the contract on April 30. After that date, it will be up to Andreani to allow the removal of the remaining materials, since Sima is completely trained to archive and operate with inputs,” he says.
The Foundation guarantees that there is no risk of interruption in the production of vaccines, especially considering that the delivery of doses of influence to the Ministry of Health has already been completed and that this production, the highest volume of Butantan, will be resumed only in the second half, as it occurs regularly.
The institution also defends the regularity of the offer process. He says that the entire procedure was conducted with transparency and within the legislation, being repeatedly validated by favorable court decisions and adds that Sima had presented a proposal with a price of 45% compared to second place, generating an estimated economy of $ 72 million. “What happened, so and simply was that Andreani lost an offer,” says Butantan.
According to the Foundation, Andreani presented several resources, all without success. In addition to the administrative appeal rejected pursuant to Butantan himself, the Company had three requests for injunction denied by the Court-Due already in the second instance and also rejected, by the State Court of Auditors (TCE-SP), the request for suspension of the event. The trial is still about to judge the merits, but the technical report of the TCE inspection ended by the regularity of the offers and the refusal of the representation made by the company.
