New options for those who want to live and work in Portugal

The uncertainty surrounding the Brazilian economy with the new directions it could take in the coming years has prompted many people to want to put into practice the plan to live and work in Portugal. Ease of language and culture itself are factors that weigh heavily in this decision.

It is also worth mentioning that the Council of Ministers of Portugal has approved an agreement that makes the requirement of procedures and documentation for the entry, stay and departure of Brazilians more flexible. Under the new rules, it is no longer necessary to appear in person to apply for a visa; present travel insurance or proof of means of subsistence and return ticket to country of origin.

It is worth noting, however, that the Brazilian citizens do not need a visa to enter Portugal for tourism, business, news coverage and cultural missionsprovided that it is for a period of 90 days. For any other situation, a visa is required for citizens of Brazil.

“Foreign investors can apply for a residence permit for investment activities, making capital transfers, creating jobs or buying real estate,” says Brazilian lawyer Fernanda Garcia, who has lived in Portugal for 12 years and heads the organization Una.ptπŸ‡§πŸ‡·

How it works for those who want to invest in Portugal

The ARI regime (Residence Permit for Investment) offers foreign investors the possibility of applying for a residence permit for investment activities, carrying out, personally or through a sole proprietorship company, an investment activity that leads to the realization of at least one of the types of investment envisaged by the Law and for a minimum period of five years.

Foreign citizens qualified for the ARI have the right to:

  • β€’ Enter Portugal without a residence visa;
  • β€’ Live and work in Portugal, and must, as a minimum, stay in Portugal for a period of not less than 7 days in the first year and not less than 14 days in subsequent years;
  • β€’ To circulate in the Schengen area, without the need for a visa;
  • β€’ Benefit from family reunification;
  • β€’ Request the issuance of a Permanent Residence Permit pursuant to the Law on Foreigners (Law n.ΒΊ23/2007, of July 4, with the current wording);
  • β€’ Possibility of applying for the acquisition of Portuguese nationality, by naturalisation, by satisfying the other requirements set forth in the law on nationality (Law No. 37/81, of 3 October, with its current wording).

Special visa for those who don’t have much money to invest

For those who have less investment capacity, but still want to live in Portugal, there is the option of a D2 or Entrepreneur Visa. This is a modality aimed at people interested in making investments in Portugal, with smaller amounts.

β€œThe acceptance or rejection of the visa application will take into account the economic and social significance of the investment made or proposed. Having opened a company in Portugal is not, in itself, a guarantee that the visa will be granted.”, warns a press release from Global VFSthe company responsible for brokering the Portuguese visa in Brazil.

To obtain this visa it is necessary to present a business plan and define the type of company one wishes to open. There are two test possibilities:

  • β€’ Proof of having carried out investment operations – business plan (summary); permanent certificate; start of business declaration; registration of the company incorporation and bank statement with the balance deposited in the company account in Portugal;
  • β€’ Proof of having financial means available in Portugal, including those obtained from a financial institution in Portugal, and the intention to carry out an investment operation in Portuguese territory, duly described and identified.

The process after receipt of the documents by VFS Global takes an average of 60 days for an opinion from the Foreign and Border Service – SEF. During this period, the applicant must remain in Brazil, being allowed to change only after the visa has been granted.

Application helps Brazilians seeking dual citizenship

With the growing number of Brazilians seeking dual nationality, so are the services that help with this journey. According to the records of the legal counsel acting in cases of Portuguese nationality, the DNA Citizenshipbetween 2021 and 2022 more than 30,000 people interested in embarking on this path were assisted.

β€œDuring the pandemic, this demand has increased exponentially. We have been working on Portuguese nationality processes for seven years, with a 50% yearly growth since then. Over the past two years, we’ve reached about 1,000 people a month. altogether, there have been more than 30,000 people interested in the dual citizenship process in the last two years, a challenging number to manage, especially when we evaluate all the steps that make up this path, the documentation and other information that are part of the procedure”, comments the lawyer Rodrigo Lopes, CEO of DNA Cidadania.
