Novo is suing the STF against the decision that allowed the nomination of politicians to state-owned companies

BRASILIA – The party New asked the Federal Supreme Court (STF) the review of Minister Ricardo Lewandowski’s decision that paved the way for the appointment of politicians by state. The decision was taken last Thursday, 16, at the request of the PCdoB. It annulled the paragraphs of the Law on State Companies which prohibited the appointment, to managerial positions, of people who held public office or who had been active in political parties or electoral campaigns in the last three years. The provision is provisional and will be judged by the plenary assembly.

The action challenging the provisions of the State-Owned Companies Act had entered the STF agenda on March 10, but the process was halted the following day due to a request for review (more time for the analysis) by Minister André Mendonça. Subsequently, the PCdoB sought an injunction (on an urgent basis) to secure the appointment of politicians for SOEs before the deadline for electing SOE directors and board members, which expires in April.

Novo argued that Lewandowski’s injunction violates the principle of collegiality, according to which decisions are taken jointly by the Court. “The exercise of this legitimate and sound right (request for reexamination), as a magistrate, by His Excellency Minister André Mendonça, however, does not seem to have satisfied some political interests that are not yet very clear to this applicant”, stated Novo in the petition.

Hours after Lewandowski’s injunction, Mendonça reacted and returned the files for judgment. It is uncommon for this return, which must be made within 90 days, to happen so quickly. Now it’s up to the President of the Tribunal, Rosa Weber, to lead the action.

The matter concerns the government of Luiz Inácio Lula da Silva, which was waiting for the easing of the rules to appoint, for example, the former governor of Pernambuco Paulo Câmara (ex PSB) president of the Banco do Nordeste (BNB) .
