This year’s Christmas pardon is the latest in the Jair Bolsonaro (PL) government, and it could have something new: the president plans to exclude members of the Armed Forces and public security professionals who are in prison from the decree. The information comes from the columnist of UOLCaroline Bridget.
The categories, which are the most important allies of the president, could lose the right to the benefit in the holidays of 2022, after the defeat at the polls. Due to the election results, Bolsonaro is considering changing his attitude towards security professionals.
Since 2019, Bolsonaro has included both classes in the Christmas pardon, also published on December 24 in the Official Gazette (DOU). The benefit entails the pardon of the sentence, and therefore the prisoner has the sentence extinguished and can be released from prison.
However, prisoners must meet certain requirements to seek their release from the courts. Under the federal constitution, those who have committed heinous crimes cannot be pardoned.
Additionally, presidential decrees usually benefit inmates with serious illnesses or physical disabilities that prevent them from serving their sentences in prison. Nonetheless, when he included classes in the Christmas pardon, Bolsonaro ruled that:
military personnel in Law and Order Assurance operations who have “culpably exceeded the bounds of necessity”;
public agents convicted of the same crime, also provided for by the penal code, as well as those who have committed an act, even off duty, “due to the risk deriving from their functional condition or due to their duty to act”.
A text was prepared by the National Council for Penal and Penitentiary Policies (CNPCP), linked to the Ministry of Justice, suggesting certain terms for the granting of the benefit, as the report recalls. But the last word belongs to Bolsonaro. According to sources in the column, the president should keep the text in its entirety, without changes, but he has until December 24 to change his mind.
Those convicted of crimes against the Public Administration are excluded from the pardon, in particular those convicted of embezzlement, extortion, passive corruption, active corruption and trading in influence”; “for gravity and repercussions”, convicted of money laundering, for the crimes provided for by the article Law of criminal organizations and for paedophilia; the text expressly mentions in the list of those excluded from the benefit those convicted of the crimes provided for by the military penal code.
