The court in Rio de Janeiro ordered the removal of the song “Millions of Years Ago”of the British singer Adelefrom all streaming platforms after considering it plagiarism of the song ‘Women’from Toninho Geraesmade popular with the voice of Martinho da Vila. According to the Brazilian composer’s defense, there is evidence to support the case.

The decision was issued last Friday, the 13th, by judge Victor Agustin Jaccoud Diz Torres, of the 6th Economic Court of Rio, and provides for a fine of R $ 50 thousandif not respected. Al EarthLawyer Fredímio Biasotto Trotta, who represents Geraes’ defense, said they had initially tried to notify the singer and the record companies, but had received no response.
“It all started with notifications, containing more than 80 pages, sent in May 2021 to Adele, Greg Kurstin, XL Recordings, Sony and Beggars Group. Only Sony responded, stating that the matter was in the hands of Adele and XL. In the meantime we were producing other evidence,” he explained.
According to him, comparative videos, analysis of scores, testimonies of musicians and listeners were collected – the “common observer test”, important in cases of plagiarism. During this trial, the defense discovered that the Universal Music Publishing MGB Brasil Ltdawhere the songs of the composer of “Donne” are edited, he was also editing Adele’s songs.
«In clear conflict of interests in favor of the British artist and to the detriment of the Brazilian composer», underlined Biasotto. “We tried to resolve it amicably, but Universal wouldn’t budge. Meanwhile, Adele remained silent, refusing to comment on the case, even in front of international journalists.”
Faced with the impasse, the defense moved forward with a contract termination action against Universal in December 2023 and, in February this year, with an action for recognition of plagiarism, co-authorship, together with compensation for moral damages and materials. The composer asks for R$1 million.
Al Jornal Nacional, Geraes declared that, with the court’s decision, he began to “feel the taste of justice”.
