STJ suspends Rose Miriam’s lawsuit for stable union with Gugu Liberato

OR Superior Court of Justice (STJ) suspended the action Rosa Miriam di Matteo he moves to have the recognition of the stable union with the leader Gugu Liberated (1959-2019). The decision, announced by Folha de São Paulo this Thursday, 29, he answered a request from Thiago Salvático, who claims to have been the boyfriend of the presenter. There is still an appeal.

In his decision, the judge Nancy Andrighi he highlighted that the action for the recognition of cohabitation brought by the cook was filed without a resolution on the merits, even before the summons of the defendants. That is, without any kind of contradiction and instruction with respect to the facts narrated. On the other hand, the lawsuit filed by Rose Miriam is already at an advanced stage.

“Given this scenario, the procedural discrepancy between the two actions is incontrovertible and clearly harmful not only to the plaintiff [Salvático]but until the very discovery of the truth about the presumed relationship between the parties and the person [Gugu] with whom they claim to have maintained a stable union in a concomitant period, with family and inheritance repercussions that will have to be properly investigated”, specified the judge.

In a note sent to Earththe defense of Rosa Miriam he said he will appeal the decision.

“Salvático had his action for recognition of the stable union extinguished in the first instance for failing to present basic elements indicating this fact […] and sought ways to disrupt and postpone Rose Miriam’s trial,” said attorney Nelson Willians.

Brazilian justice does not allow the recognition of stable simultaneous partnerships.

Inheritance dispute

The dispute for legacy of Gugu Liberato, worth R $ 1 billion, is the target of at least two lawsuits in court. One investigates the validity of the will left by Gugu and the other is the request for recognition of a stable union advanced by Rose Miriam.

On June 20, the STJ recognized the validity of the will left by Gugu in 2011, which did not include Rose Miriam, mother of the presenter’s three children: João Augusto, Marina and Sofia Liberato. The STJ’s decision complied with the will, which awarded 75% of the estate to his three children and 5% to each of his 5 grandchildren.

If Rose Miriam is recognized in a stable union, she is entitled to half of the presenter’s estate. The same goes for Thiago Salvatico. Brazilian law does not allow both Rose and Thiago to have recognized stable partnerships with Gugu.

The trial caused division in the Liberato clan. Her mother is joined by her daughters, Marina and Sofia. Already the eldest of guguJoão Augusto sided with the family of his father and aunt, Aparecida Liberato, who were against the recognition of the stable union between Rose Miriam and Gugu.

But the dispute gained another twist with the emergence of a possible 4th child of the presenter. Ricardo Rocha, 48, claims that Gugu was his biological father and has launched an investigation into his paternity.

In parallel, Mr. Salvatico has been looking for ways to stop and defer Rose Miriam’s lawsuit.

As reported in the press, this gentleman appeared in the middle of the trial, more than a year after Gugu’s death, coming to light recently. The relationship he recounts is far from a stable union, at most it would be a clandestine relationship.

Interestingly, Rose Miriam di Matteo has already given her testimony, as well as Marina and Sofia Liberato. The hearing, scheduled for Monday (3), was to collect the testimony of a last witness from the counterparty, who was unable to attend the hearing on 22 June. Hopefully, in the end, justice will be done and the truth will prevail.”
