Paula Toller gets legal clearance and will use the songs with Leoni

Justice authorizes Paula Toller to include songs like “Pintura Íntima” and “Como Eu Quero” in a project celebrating her 40-year career.

Singer Paula Toller has obtained judicial authorization to use compositions created in collaboration with her ex-husband Leoni in her career commemorative project. The decision was issued on Friday (24) by the 16th Chamber of Private Law of the Court of Justice of Rio de Janeiro, in first instance, without the possibility of appeal for the musician.

The legal conflict began when Leoni refused to allow the use of seven songs created together, including “Pintura Íntima” and “Como Eu Quero”, in the show “Amorosa – Tour 40 Anos”, recorded in Rio de Janeiro.

Leoni based his refusal on copyright law, claiming that he had the right to veto the use of the works without the need for justification. The information was released by the F5 website.

The two artists maintained a romantic relationship in the 1980s, when they were part of the band Kid Abelha. During the trial, Paula argued that Leoni’s refusal was based on personal disagreements and previous legal disputes between them.

The court held that interpreting the copyright law literally in the case of co-authorship of songs would be contrary to the principle of reasonableness and the social function of art, as reported by the F5 website.

With the favorable decision, Paula Toller will be able to incorporate the songs into planned audiovisual material and make them available on digital platforms, as planned in her 40th anniversary commemorative project.
