The fast food chain Burger King faces a class action lawsuit in the United States, on charges of deceiving customers. The complaint alleges that Whopper sandwiches are sold over the counter 35% smaller than what is listed on the menu. Furthermore, the complaint also states that the snack appears to contain twice as much meat as that marketed.

Burger King attempted to dismiss the lawsuit, but a judge kept the lawsuit open. The magistrate ruled that from now on the company has the right to defend itself against this accusation. There is currently no date for the trial.

According to the American newspaper NBC Newsthe lawsuit, filed by attorney Anthony Russo on April 4, 2022, alleges that BK began scaling back its burgers around September 2017. A Burger King spokesperson spoke with BBC regarding the allegations.

“The grilled beef patties depicted in our ad are the same ones used in the millions of Whopper sandwiches we serve to customers across the country,” he said.

This isn’t the first lawsuit filed against the fast food chain. In 2022, he had to rename the “Whopper Costela” burger to “Whopper Palette Suína,” as some customers claimed the meat in the bun wasn’t ribs. On Burger King’s website, the chain reported that the sandwich is made with “pork burgers with that unmistakable rib-eye aroma.”

According to the Burger King website, it comes with a 4 oz. grilled beef patty, sesame seed bun, melted cheese, pickles, fresh salad (lettuce, onion, tomato), ketchup, and mayonnaise.  The price of the snack is R$ 27.90.

This has also happened with other brands, such as McDonald’s, which has sold McPicanha, but without this cut in the composition.
